Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your use of ConvertLab, a Shopify application provided by Xiza Digital Ltd ("we", "our", or "us"). By installing or using ConvertLab, you agree to be bound by these Terms.
If you are using ConvertLab on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Service Description
ConvertLab is an A/B testing application for Shopify stores that:
- Generates AI-powered product description variants
- Conducts automated A/B tests on your Shopify store
- Tracks conversion metrics and statistical significance
- Allows one-click publishing of winning variants
3. Account and Access
3.1 Shopify Account
To use ConvertLab, you must have an active Shopify store. Your use of Shopify is governed by Shopify's terms of service. We are not responsible for any issues arising from your Shopify account.
3.2 Access Permissions
When you install ConvertLab, you grant us permission to access certain data from your Shopify store as described in our Privacy Policy. You may revoke this access at any time by uninstalling the application.
3.3 Account Security
You are responsible for maintaining the security of your Shopify account. We are not liable for any unauthorised access resulting from your failure to protect your account credentials.
4. Subscription and Billing
4.1 Pricing Plans
ConvertLab offers tiered subscription plans with different features and limits. Current pricing is displayed in the Shopify App Store and within the application. We reserve the right to change pricing with 30 days' notice.
4.2 Free Trial
We offer a 14-day free trial on all plans. During the trial, you have full access to the features of your selected plan. At the end of the trial, you will be charged unless you cancel or downgrade.
4.3 Billing
All billing is processed through Shopify's billing system. Charges appear on your Shopify invoice. We do not directly collect or store payment information.
4.4 Cancellation
You may cancel your subscription at any time by uninstalling the app from your Shopify store. Cancellations take effect at the end of your current billing period. We do not offer refunds for partial billing periods.
5. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to gain unauthorised access to our systems or other users' data
- Use the service to generate content that is illegal, harmful, or violates third-party rights
- Reverse engineer, decompile, or attempt to extract source code
- Use automated means to access the service beyond normal application usage
- Resell or redistribute the service without our written permission
- Interfere with or disrupt the service or servers
6. AI-Generated Content
6.1 Ownership
You retain ownership of your original product descriptions. AI-generated variants created by ConvertLab are licensed to you for use in your Shopify store. We do not claim ownership of generated content.
6.2 No Guarantee
While we strive to generate high-quality content, we do not guarantee that AI-generated descriptions will be error-free, factually accurate, or suitable for your specific needs. You are responsible for reviewing and approving all content before publishing.
6.3 Your Responsibility
You are solely responsible for ensuring that published content complies with applicable laws, advertising standards, and does not infringe third-party rights.
7. Intellectual Property
ConvertLab, including its code, design, features, and documentation, is owned by Xiza Digital Ltd and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the service as intended.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XIZA DIGITAL LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless Xiza Digital Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you publish using the service
11. Termination
We may suspend or terminate your access to the service at any time, with or without cause, with or without notice. Upon termination, your right to use the service ceases immediately. Sections of these Terms that by their nature should survive termination shall survive.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
